Terms and Conditions

We may amend these Terms for commercial, legal or customer-service reasons. The current version, with its effective date, is always available on the site. Where changes are substantial we will give reasonable prior notice by email, in-client message or site notice. Continued use after changes take effect means you accept the updated Terms.

To register and play you represent and warrant that:

• You are at least 18 and meet the minimum gambling age in your jurisdiction.
• You are not an employee or contractor of the Company or any group company.
• You are legally able to enter into contracts and will abide by these Terms.
• You have not been excluded or self-excluded from gambling, and have not previously had an account closed by us.
• You are responsible for ensuring your use complies with the laws of your jurisdiction.

You may open only one account. Duplicate accounts may be blocked or closed and any winnings or bonuses on them forfeited and reclaimable, with an administration fee. You must keep your details up to date. To close your account, email support@kothpoker.com. We may suspend or terminate an account that breaches these Terms or is opened from a prohibited jurisdiction.

You warrant that you are of legal age, that your registration details are correct, and that deposited funds are not derived from illegal activity. We comply with applicable AML and counter-terrorist-financing laws and may investigate and report suspicious transactions. We may carry out verification checks at any time and will require a government photo ID and a proof of address dated within the last 90 days before processing a withdrawal. Withdrawals may be delayed and accounts suspended where documents are outstanding. Where age cannot be verified, the account is frozen and no play is permitted until verification is complete.

Participation is at your discretion and risk. Real-money play is speculative; you confirm you can withstand any losses. It is your responsibility to ensure your transaction details are correct.

Only bets placed from your own account via the game client will be accepted, and winnings are credited to that account. We may refuse or limit any bet or payout at our discretion; bets are valid only once accepted by our server. Your account is personal to you — you must not allow others to use it, and you are responsible for keeping your password secure and for all activity under your account.

Funds you deposit are held in a segregated account in the Company's name, kept separate from operational funds and reconciled to player balances. Monies held in your account do not attract interest.

• No use that is unlawful, infringing, fraudulent, defamatory or harmful.
• No distribution or resale of the services to third parties without consent.
• No transmission of viruses, malware or malicious code.
• No modifying, reverse-engineering or interfering with our software, and no breaking or circumventing security measures.
• Any bot or artificial-intelligence assistance is strictly prohibited.

We may exclude any customer from the services or from selected promotions at our discretion, and may suspend, modify or remove the site or games.

Deposits may be made via the methods shown in the cashier, including cards and cryptocurrencies. Minimums apply per method. You may only use payment instruments that lawfully belong to you. We do not accept cash, and you agree not to charge back, reverse or cancel deposits.

Minimum and maximum withdrawal limits may apply. Withdrawals are normally returned to the same method from which funds were deposited, unless that method is shown to be lost or cancelled. All deposits must be cleared and not charged back before withdrawal. We may request further information before processing, and may charge an administration fee for withdrawals of funds that have not been put into play. You are responsible for reporting your winnings and losses to your tax authorities.

Held funds are part of your total poker cash balance and relate to poker winnings from the previous 72 hours. Profits from poker sessions are not immediately available to withdraw; they are held in your poker wallet for 72 hours. They remain available for use at the poker table during that period. Where suspicious or collusive play is identified, we may block access and suspend withdrawals while we investigate.

Bonuses and promotions are governed by their own terms, which prevail over these Terms in the event of conflict. Where we believe a bonus or promotion is being abused, we may deny, withhold or withdraw it and may close the account; in such cases we are not obliged to refund any balance beyond your original deposit. By taking part in a promotion you agree to reasonable related publicity.

We may suspend or terminate your account, cancel bets and remove bonus monies where we suspect illegal or fraudulent activity, collusion, manipulation, a breach of these Terms or the Security policy, conduct detrimental to our business, or where required by law. Your sole remedy on termination is reimbursement of any undisputed account balance.

We operate security procedures to protect customers and the network from fraud and collusion. Bots and AI are strictly prohibited. Checks may result in temporary suspension of accounts and requests for information, and play is conditional on accepting our Security policy.

• You may not bet in excess of the chips on the table at the start of a hand; additional chips may be acquired only between hands.
• “Table talk” or chat that compromises an opponent’s hand is not permitted.
• Abusive or offensive language or conduct will not be tolerated and may lead to suspension.
• All game outcomes are determined by certified random number generator software.
• You must not interfere with or attempt to manipulate the operation of the games.

If you hold chips at a table during a server crash, the game is cancelled and chips in play are returned to your account. We are not liable for losses from delays, interruptions, equipment or connection failures, or denial-of-service attacks. In the event of systems or settlement errors we may void affected bets and plays. For RNG casino games, disconnected games resume or are completed by the RNG; for live tables, placed bets remain valid and are settled; for slots, you may resume the game on reconnecting.

These Terms grant only a right to use the site and games while in effect and convey no ownership. All intellectual property in the platform, software and games remains the property of the Company and its licensors.

By registering for a tournament you agree that we may use your play data, nickname, finishing position and payouts in streams, broadcasts and other publicity. We do not publish your real name or personal information without written permission, except where you consent during registration for specific named tournaments. Final tables may be broadcast with hole cards shown on a delay.

You agree to indemnify and hold harmless the Company, its affiliates, officers, agents and employees against any third-party claim arising from your breach of these Terms, your violation of any law or third-party right, or your use of the site and games.

The services are provided on an “as is” and “as available” basis without warranty of any kind to the maximum extent permitted by law. Our maximum liability for any matter connected with your use of the site is limited to the aggregate of the funds legitimately in your account and the stake of any disputed bet. We are not liable for indirect or consequential loss, loss of profit or goodwill, or loss caused by events outside our control. Nothing limits our liability for fraud, death or personal injury caused by our negligence.

An account with no deposit, withdrawal, bet placed or bet settled for a continuous period of 12 months is treated as dormant. We may charge a handling fee of US$5 per month (or the remaining balance if lower) until the account is reactivated or reaches a nil balance. Personal data relating to dormant accounts is deleted when no longer needed.

Complaints should be sent to support@kothpoker.com and will be assigned to a customer-support representative. Where a resolution cannot be reached, you may seek external resolution from the Curaçao Gaming Control Board at portal.gamingcontrolcuracao.org.

These Terms are governed by and interpreted in accordance with the laws of Curaçao.

If any provision is found unenforceable, the remainder continues in force. No partnership, employment or agency relationship is created by these Terms. Our failure to exercise a right is not a waiver of it. These Terms are the entire agreement between you and us relating to use of the games.
